Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. Terms of Use for the Custom Neon/Sign Price Simulator
Price Estimates: The prices provided by our simulator for custom neons are based on user configuration choices. These estimates are calculated in real time and are subject to change based on the detailed specifications of the project.
Approximate Nature: The estimate provided by the simulator is approximate and non-binding. The final price may vary based on a more detailed assessment of the project's requirements.
Right to Review and Adjust: We reserve the right to revise the estimated price after detailed modeling. If the actual price significantly differs from the estimate, we will contact the buyer to discuss options, which may include price adjustment or refund.
Right to Refuse and Refund: In case of a price adjustment due to a discrepancy between the estimated and actual price, the client is always entitled to refuse the adjustment and may choose to receive a full refund instead.
Acceptance of Terms: By using the simulator, the user accepts these terms and acknowledges the approximate nature of the provided estimates.
SECTION 7 - OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

In no case shall The Swiss Neon, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless The Swiss Neon and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 16 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of United States.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. SECTION 21 - RESPONSIBILITIES RELATING TO IMPORT TAXES, CUSTOMS DUTIES, AND VAT
(a) The customer acknowledges that any import taxes, customs duties, and VAT that may be levied upon importing goods into any country, including Switzerland, are the sole responsibility of the customer. These additional charges are governed by local regulations and are independent of the sale price and shipping fees charged by The Swiss Neon.
(b) Customs duties and VAT are determined by the destination country's competent authorities and are beyond the control of The Swiss Neon. As such, The Swiss Neon cannot predict or influence their amount.
(c) By accepting these General Terms and Conditions of Sale, the customer agrees to pay in full all import taxes, customs duties, and VAT as required by their country of residence. The customer is obliged to inquire about these costs from their local customs authorities before making a purchase on our site.
(d) The customer is considered the registered importer of the goods and must comply with all laws and regulations applicable in the receiving country. It is their responsibility to ensure that the importation and use of products purchased from The Swiss Neon are legal in their country.
(e) The Swiss Neon is not responsible for delays caused by the customs clearance process, nor for the financial consequences resulting from the client's non-payment of taxes and duties.
SECTION 22 - CONDITIONS OF WARRANTY FOR NEON/ 3D LED SIGNS
Our warranty covers only the delivery of defective parts, such as neon tubes, transformers, modules, or any other relevant technical component. However, this warranty does not apply to the installation, dismantling, or replacement of the defective item. Any work related to the installation or assembly of the sign is the responsibility of the customer or must be carried out according to the provisions of section 25 if the initial installation was handled by The Swiss Neon, outside the scope of the warranty. We strongly advise customers to take all necessary precautions to ensure a proper installation and to consult qualified professionals if needed.
THE WARRANTY PERIODS LISTED ABOVE REPRESENT THE STANDARD COVERAGE, UNLESS A LONGER PERIOD IS SPECIFIED IN YOUR QUOTE OR ON THE PRODUCT PAGE, CORRESPONDING TO AN OPTIONAL WARRANTY EXTENSION SELECTED.
Warranty for "Indoor" Neon Signs: All our neon signs designed for indoor use come with a full 2-year warranty (unless otherwise specified in the product description) from the date of purchase. This warranty covers all manufacturing and operational defects under normal conditions of use. If during this period, your neon sign exhibits a malfunction or failure due to a manufacturing defect, we commit to repairing or replacing it free of charge, according to our terms.
Warranty for "Outdoor (Waterproof)" Neon Signs:
(a) Our neon signs labeled “waterproof” and expressly designed for outdoor use are covered by a limited 2-year warranty from the date of purchase (unless otherwise specified on the product page). This warranty is expressly limited to outdoor use under shelter and does not apply if the product is submerged or exposed for prolonged periods to the elements without adequate protection.
(b) The warranty conditions exclude damages resulting from improper use, accidents, inadequate maintenance, or unauthorized modifications to the product. Precautions must be taken to avoid prolonged exposure to extreme weather conditions, including but not limited to heavy rain.
(c) To activate the warranty, proof of purchase is required. Costs associated with returning the product for warranty service are the sole responsibility of the customer.
(d) The warranty provided for waterproof neon signs is strictly non-transferable and benefits only the original purchaser of the product. This warranty does not cover damages arising from the use of the neon sign in an uncovered environment or from immersion in liquids.
SECTION 23 - PRODUCTION ORIGIN AND TAX IMPLICATIONS
(a) The Swiss Neon is committed to delivering the best value for money. To this end, we select our production sites around the world based on their ability to meet our high standards.
(b) Purchasing products from our range may incur additional costs due to import taxes, customs duties, and VAT, in accordance with the laws in force in the country of receipt of the goods.
(c) Customers are advised to consider that these additional costs are not included in the purchase price displayed on our site. It is the customer's responsibility to inquire about any additional fees with the competent authorities in their country.
(d) The responsibility to pay any tax or duty rests solely with the customer, as detailed in Section 21 of our General Terms and Conditions of Sale, where we address in more detail the tax issues related to importation.
(e) The Swiss Neon is not liable for any additional costs or consequences arising from the customs regulations of the destination country. However, we are available to provide advice and information to facilitate the import procedures for our customers.
SECTION 24 - REMINDER FEES AND DEBT COLLECTION
(a) In case of non-payment within the specified deadlines, we reserve the right to send multiple reminders to the client. The first reminder and the final reminder will each incur an additional fee of 50 CHF, amounting to a total of 100 CHF for both reminders.
(b) If, despite these reminders, payment is not made, we reserve the right to initiate a debt collection procedure in accordance with applicable legal provisions. The costs associated with this procedure will be fully borne by the client.
(c) We strongly encourage our clients to promptly address any outstanding invoices to avoid additional fees and administrative procedures. For any questions regarding reminders or payment deadlines, please contact our customer service at support@theswissneon.ch.
SECTION 25 - INSTALLATION AND MAINTENANCE
(a) Initial Installation: For quotes that include installation, the price only covers the first installation of the sign. This price does not include subsequent services such as repairs, adjustments, or maintenance.
(b) Maintenance and Subsequent Services: Any maintenance or repair work after the initial installation is billed as follows:
- Travel costs: Between 100 CHF and 250 CHF, depending on the region.
- Hourly rate: 100 CHF/hour, depending on the type of maintenance required.
(c) Special Installations: Installations requiring special equipment, such as cranes, lifts, or other specialized tools, are not included in the standard quote. These additional costs are the sole responsibility of the client and will be invoiced separately.
(d) Maintenance Requiring Specialized Equipment: Maintenance requiring the use of specialized equipment (e.g., lifts or other precise tools) will also be billed to the client. These costs include the rental or deployment of the necessary equipment, in addition to travel and hourly fees.
We recommend our clients consider these potential costs when planning their projects and scheduling regular maintenance to ensure the longevity and proper functioning of their signs. For any questions or maintenance quotes, please contact us at support@theswissneon.ch.
SECTION 26 — SAFETY INSTRUCTIONS, INTENDED USE, AND INSTALLATION REQUIREMENTS
(a) Intended Use (Permitted Environments)
Our LED neon signs are intended for decorative lighting and must be used only:

Indoors, in dry and well-ventilated environments, at normal ambient temperature; and
-
On stable, non-combustible or low-combustibility surfaces (e.g., concrete, brick, plaster, metal, tile), using appropriate fixings.
If a product is explicitly sold as “Outdoor / Waterproof”, the permitted outdoor use is limited to outdoor use under shelter, unless expressly stated otherwise on the product page and documentation.
(b) Electrical Safety Requirements

The sign must be powered only with the original power supply/transformer provided with the product or a strictly equivalent certified replacement.

The power supply must be connected to a properly installed and protected electrical outlet.
-
No modification of wiring, connectors, transformer, dimmer, controller, or internal components is permitted.
-
Do not operate the sign if any cable, connector, transformer, controller, dimmer, or casing is damaged, pinched, overheated, emits unusual odor, or shows signs of melting/discoloration. Disconnect immediately.
- The transformer/power supply and any dimmer/controller must be kept and operated only in a dry, non-humid location, protected from water and away from any source of moisture (e.g., sinks, bathrooms, wet floors, condensation, splashes, outdoor exposure). Do not place these components on the floor in areas where water may accumulate.
Cable Handling & Strain Relief (Important):
5. The sign must be handled and positioned so that no tension is applied to cables or connectors. In particular, do not pull, lift, carry, or move the sign by the main cable or any connector—always hold the sign by its rigid structure/backboard.
6. Ensure the main cable is not pinched, sharply bent, trapped, or placed where it can be snagged. Where relevant, use strain relief (e.g., cable clips) so the connector is not bearing the weight of the cable.
(c) Installation Requirements (Customer Responsibility)

Installation must be performed in accordance with our installation guide and all applicable local regulations.

For any professional setting (commercial premises, public venue, workplaces) or any installation involving elevated mounting, fixed wiring, or integration into a building system, we strongly recommend installation by a qualified electrician / professional installer.

The customer is responsible for verifying that the mounting surface and fixings can safely bear the load and that the sign is mounted securely to prevent falling, vibration damage, or cable stress.

The sign must be installed so that the power supply/transformer has adequate airflow and is not enclosed in a way that may cause overheating.
- Safety distancing requirement: The neon LED sign (including its backboard) must be installed at a minimum distance of at least 2 meters from the transformer (power supply) and any dimmer or control unit. All components must be installed in a well-ventilated, non-flammable environment. This separation is required to reduce the risk of overheating, fire propagation, electromagnetic interference, and premature equipment failure. Failure to comply with this requirement constitutes improper installation and use, may void any warranty or insurance coverage, and transfers full responsibility and liability to the installer or end user.
(d) Prohibited Use (Strictly Forbidden)
For safety reasons, it is strictly prohibited to:

Install the sign on or directly against flammable materials (including but not limited to acoustic foam, polyurethane foam, polystyrene, untreated wood, textiles, cardboard, paper, decorative moss, dried plants, and similar materials).

Install the sign inside or near high-heat sources (open flames, gas heaters, cookers, fireplaces) or in environments with excessive heat, steam, grease, or chemical vapors.
-
Use the sign in wet areas (bathrooms without adequate ventilation, saunas, near pools, outdoor exposure without shelter) unless the product is explicitly sold and documented as suitable for such use.

Cover the sign or transformer, restrict ventilation, or place the transformer in closed spaces where heat cannot dissipate.

Use the sign with third-party transformers, third-party wiring, non-original connectors, or homemade adapters.
(e) Use in Bars, Clubs, Restaurants, Hotels, and Public Venues (Enhanced Safety Rule)
For installations in public venues or commercial spaces accessible to the public (including bars, clubs, restaurants, hotels, event spaces, and similar venues), the customer must ensure compliance with local fire safety requirements and any applicable building/fire regulations, including any required approvals by competent authorities and/or insurers.
Where local fire safety regulations require specific material classifications, mounting methods, placement constraints, or documentation, the customer is responsible for obtaining any necessary approvals prior to installation.
(f) Inspection, Maintenance & Safe Operation

The sign should be periodically inspected for: loosened fixings, damaged cables, abnormal heat, unusual odor, discoloration, flickering, or transformer noise.

If any abnormal behavior is detected, the sign must be switched off and disconnected immediately and the customer must contact us before further use.

The sign must not be left operating unattended for long periods in environments where safe supervision is required (commercial premises should follow their internal safety policies).
Prolonged Use / Rest Period (Recommended):
4. For prolonged continuous operation, we recommend applying periodic rest intervals to reduce thermal stress on electrical components: after approximately 5–6 hours of continuous use, switch the sign OFF for at least 20 minutes before resuming operation. In warm environments or commercial settings, more frequent rest intervals may be appropriate.
(g) Limitation Related to Misuse / Non-Compliant Installation
